Harrogate businessman spared jail for sexually assaulting woman in street

A Harrogate businessman who sexually assaulted a woman in the street has been spared prison.

Paul Harper, 41, touched or “groped” the young woman on an intimate part of her body while the victim was walking hand in hand with her boyfriend in Harrogate town centre, York Crown Court heard.

Harper, a married father-of-three, denied the offence but a jury found him guilty following a trial.

He appeared for sentence yesterday for his inexplicable and “predatory” act which occurred at night, in a crowded street “in the middle of Harrogate”, in August 2021.

The court heard that Harper, of Hollins Lane, Hampsthwaite, “brazenly” walked off after the bizarre act, leaving the Harrogate woman “aghast, shocked and distressed”.

Prosecutor Michael Morley read out a statement from the victim, who described the dramatic effect the incident had had upon her.

She said she found the experience “shocking” and described Harper’s behaviour as “outrageous, disgraceful and predatory”.

She couldn’t understand what she had done “which had attracted this man’s attention” and said she had been treated like an “object”. It made her feel “less secure” in a town where she had previously felt safe. Mr Morley said:

“She regarded Harrogate as a fairly safe town and never felt there were problems there, but she feels less safe in her home town now…and upset that her parents saw the state she was in (when she returned home).”

The victim said her “outrage and bewilderment” had been compounded by the fact that incidents such as this in Harrogate and elsewhere appeared to be “commonplace” now, or “just one of those things girls have to deal with”.

She had undergone therapy since the incident to deal with feelings of “anxiety and sadness”.

Defence barrister Helen Chapman said Harper’s business and his employees would suffer if he were sent to jail. He was a man “of some means” and his family were dependent upon him.

Community order

Judge Simon Hickey told the disgraced businessman:

“In a crowded street in the middle of Harrogate, you decided to (sexually assault) a young woman…then you brazenly walked off, leaving that woman aghast, shocked and distressed that she could go out in a public street and still be molested.

“You said at trial, ‘I’m not some seedy guy who goes around imposing myself on young (women)’. I’m afraid that’s precisely what you are and that’s why you decided you could grope a woman when she was simply holding her boyfriend’s hands.”

The judge said he had noted the “significant” effect the attack had had on the victim, who cannot be named for legal reasons.

However, he said he wasn’t going to lock Harper up, “although many women may feel that that’s exactly what should happen to you”.

Mr Hickey said he could veer away from a jail sentence because of the effect this would have on Harper’s family.

Instead, Harper was given a two-year community order and placed on the sex-offenders’ register for five years. He was also given a 10-year restraining order banning him from contacting the victim.

In addition, he was ordered to complete up to 43 days of a sex-offenders’ group work programme, 80 hours’ unpaid work and a 55-day rehabilitation course. He was also made to pay £3,135 prosecution costs.

Harrogate police officer pleads not guilty to sexual assault

A Harrogate police officer pleaded not guilty in court today after being charged with sexually assaulting a woman.

Joseph McCabe, 27, of Starbeck, is currently suspended from duty as a North Yorkshire Police officer based in Harrogate.

The officer appeared before York Magistrates Court this morning charged with sexual assault by touching. The case concerns an alleged incident at a North Yorkshire property last summer.

Prosecutor Charlotte Dangerfield said Mr McCabe, was allegedly “trying to stroke” the woman, who cannot be named for legal reasons.

It was also alleged that he was pulling at her hair, added Ms Dangerfield. She alleged that Mr McCabe was trying to have sex with the woman who was unwilling.

The defendant’s solicitor, Mr Hague, claimed the incident was “not sexual in nature” and added:

“He [Mr McCabe] thought there was going to be sexual interaction (but) she rejected it and he respected that”.

The magistrate questioned Mr Hague about the relationship between the defendant and the woman. Mr Hague responded and said:

“It had been a friendship for sometime with regular friendly communication, just a typical workplace relationship.”

Mr McCabe is set to appear before York Magistrates Court again on October 11 and has been released on unconditional bail.

Harrogate police officer charged with sexual assault

A Harrogate police officer is to appear in court this week charged with sexual assault.

Joseph McCabe, of Kingsley Park Road, Starbeck, will appear at York Magistrates Court on Thursday.

He is accused of touching without consent at Scotch Corner Services, near Richmond, in August last year.

The 27-year-old officer is a serving North Yorkshire Police officer based at Harrogate police station.

He is currently suspended from duty.

Man comes forward after CCTV appeal over Harrogate sexual assault

A man has come forward after police issued an appeal following a serious sexual assault in Harrogate.

The incident took place on Oxford Street in Harrogate between 2.30am and 3am on Thursday, November 25 last year.

North Yorkshire Police issued a CCTV image yesterday of a man they wanted to speak to in connection with the incident.

The force confirmed today that a man has come forward following the appeal.

Knaresborough man denies sexual assault and child exploitation charges

A Knaresborough man has denied a string of sexual assault charges and inciting the exploitation of children.

Anthony Medri, 63, of Forest Moor Road, is charged with intentionally causing a child to look at an image of a person engaging in sexual activity for the purpose of obtaining sexual gratification.

He is also charged with three counts of sexual assault on a female and three counts of causing or inciting the sexual exploitation of a child he did not reasonably believe was aged 18 or over to become a prostitute to be involved in pornography.

Mr Medri, who stood unsuccessfully for the Liberal Democrats in the 2015 local elections when he contested the Stray ward. appeared at Harrogate Magistrates Court this morning to confirm his name and age.

He entered a plea of not guilty to all seven charges.

He was granted bail and will appear at York Crown Court for trial on April 19, 2022.

 

Harrogate police officer pleads not guilty to alleged sexual assault

A Harrogate police officer has pleaded not guilty after being charged with sexually assaulting a woman while on duty.

Christopher Ryan Hudson, 31, appeared before Leeds Crown Court for a preliminary hearing today where he entered his plea.

The alleged offence is said to have taken place at Stonefall Cemetery on Wetherby Road, Harrogate, on February 8.

He is accused of sexually touching the woman, who cannot be named for legal reasons, while he was on duty.

Mr Hudson, of Hollin Terrace, Huddersfield, spoke to confirm his name and that he understood his bail conditions, which include no contact with the alleged victim.

Judge Simon Batiste imposed the new conditions before adjourning the case for a trial on February 20, 2023. He blamed the delay on a “considerable backlog in the courts”.

North Yorkshire Police said in a statement that Mr Hudson was based in Harrogate at the time of the allegation and was currently suspended.

Harrogate police officer denies sexual assault while on duty

A Harrogate police officer appeared in court today charged with sexually assaulting a woman.

Christopher Ryan Hudson, 30, who was suspended by North Yorkshire Police after the allegation was made, appeared at York Magistrates’ Court on Thursday when he denied one count of sexual assault.

The alleged offence is said to have occurred at Stonefall Cemetery on Wetherby Road, Harrogate, on February 8.

Hudson, who was based in the Harrogate police division at the time of the alleged offence, was dressed in a smart black suit, white shirt and tie when he appeared before district judge Adrian Lower.

He is accused of sexually touching the woman, who cannot be named for legal reasons, during working hours and in a “relatively remote location”.

Prosecutor Charles Macrae said it was alleged that Mr Hudson sexually touched the woman while she “repeatedly told him she didn’t want him to”. Mr Macrae added:

Matthew Savage, for Hudson, said he had no submissions to make at this stage.

Judge Mr Lower sent the case to Leeds Crown Court where Mr Hudson, of Hollin Terrace, Huddersfield, will appear on January 6 for a preliminary hearing. He was released on unconditional bail.

North Yorkshire Police said in a statement that Hudson was based in Harrogate at the time of the allegation and was currently suspended.

Woman sexually assaulted at Harrogate train station

Police have released an image of a man they want to speak to following a sexual assault at Harrogate Station.

A woman waiting for a train was approached by a man who tried to strike up a conversation with her shortly after 7pm on Saturday August 7.

The woman turned away but the man continued to speak before sexually assaulting her.

British Transport Police said in a statement today:

“Officers believe the man in the image may have information which could help their investigation.”

Ripon man jailed for grooming and sexual abuse of 15-year-old girl

A 68-year-old man has been jailed for over six years for historic child abuse in Harrogate.

Malcolm Peter Barwick, who now lives in Ripon, was sentenced to six and a half years in jail today after pleading guilty to seven counts of sexual activity with a child.

The abuse occurred at Woodfield Drive in Harrogate where the victim was sexually abused by Barwick between April 2014 and April 2015.

The victim, now in her early 20’s, reported the abuse to North Yorkshire Police in June last year. An investigation was then launched by Harrogate CID.

Barwick appeared at York Crown Court today. As well as the jail sentence he is subject to an indefinite Sexual Harm Prevention Order and he will remain on the Sex Offenders’ Register for life.

Detective Constable Matthew Reeve said:

“The effect this case has had on the victim has caused a lifetime of trauma and has deeply affected her.

“She showed true bravery in reporting the matter to the police and seeing the case through. I really hope this outcome will give her the strength to move on from this horrendous experience.”

“Barwick is a predator who targets vulnerable youths and grooms them for his own sexual gratification. Dangerous and manipulative offenders like him deserve to be behind bars.”

Second sex attack in a month on Harrogate’s King’s Road

Police are investigating a second sexual assault of a teenage girl on Harrogate’s King’s Road in less than a month.

North Yorkshire Police said today a 17-year-old was approached from behind by the man, who touched her bum and chest on the corner of King’s Road and Coppice Drive.

The incident happened at about 3.50pm on Monday.

The 17-year-old victim told police the man then walked back in the direction he had come from, towards the A61 junction.

Police described the suspect as white, aged in his 20s, of thin build and with a long, clean shaven face. They also said he has long, light brown and slightly curly hair that was tied back.

Police believe he was wearing a red and grey backpack.

The victim and her family are being supported by police while enquiries continue.

Second attack in a month

An 11-year-old girl was sexually assaulted on the corner of Chatsworth Grove and King’s Road on May 25.

The young girl was walking home from school at around 3.15pm when the attack happened.

Harrogate High School and Willow Tree Community Primary School subsequently revealed they had alerted police to men harassing pupils.
