North Yorkshire Council officers have defended its planning service following a sharp decline in the number of development proposals being decided by councillors.

A meeting of the council’s transition scrutiny committee was told the authority was re-examining the balance between planning applications which could be made by unelected council staff and ones which went before the authority’s six area planning committees.

The authority’s planning service has been the focus of criticism by many councillors since it took over from the seven district and borough councils in April, with some areas seeing decreases of 60% in the number of decisions by councillors.

A recent meeting of all the planning committee chairs heard claims the council was only giving councillors the chance to decide upon developments it was legally bound to and had made its scheme of delegating decisions to planning officers “so tight that nothing’s really coming through”.

Harrogate councillor Philip Broadbank, a Liberal Democrat who represents Fairfax and Starbeck, told the meeting since April Harrogate borough had seen two planning meetings cancelled due to the lack of proposals being put before councillors and just one proposal being considered at other meetings.

He added that the move had led councillors to conclude that they were no longer closely involved with the planning process.

Cllr Broadbank said while 92% of planning applications had previously been decided by officers, it appeared the number being decided by elected members was getting fewer.

The meeting heard while much time was spent developing conditions which developers would have to adhere to to make a development acceptable, “sometimes it’s quite obvious nothing is done about enforcement to follow up if anything goes wrong”.

Cllr Broadbank said: 

“Elected members are there for a purpose. They are the ones who go round knocking on doors, they are the ones who need to be involved some of the decision-making that’s going on.”

The meeting was told town and parish councils were “tearing their hair out” over the lack of or delays in enforcement action, often due to a lack of available legal support.

Committee members heard the Scarborough borough area had had no dedicated enforcement resource “for quite some time”, while Richmondshire was in a similar situation.

Grappling with change

Planning officers said councillors were able to call in contentious applications for committees to consider if there were sound planning reasons.

They said the council was examining where to focus its enforcement resources and legal support needed for an effective enforcement service.

Officers said they were “grappling with” whether the authority’s delegation system needed changing and that they were working to understand which proposals were decided by committees previously.

An officer underlined there had been no attempt to try to block some proposals going before councillors and officers were “trying to understand where those lines should be drawn”.

He added the authority would examine changing the balance over which planning applications should go before councillors.

The officer said: 

“The intention here isn’t to disenfranchise members. Members are a key part of this process.”

North Yorkshire Council has revealed the spend for councillor’s locality budgets for the last financial year.

Each councillor on the authority is given a budget of £10,000 to spend in the area they represent.

The money is spent on small schemes which “promote the social, economic or environmental wellbeing of the communities they represent”.

This can include items for local charities, maintaining public footpaths and cleaning memorials or attractions.

Projects and activities can include services provided by the council provided that these are additional to normal service levels and do not create an ongoing expenditure commitment for the council

As Harrogate Borough Council draws to a close, the move to scrap the authority also sees 24 councillors lose their roles.

The brand new North Yorkshire Council will have 16 elected representatives from the Harrogate district.

However, only 12 of those councillors will move on from seats on the borough council.

Some have successfully sought reelection to the new council.

Among those stepping down include council leader, Cllr Richard Cooper, and deputy leader of the authority, Cllr Graham Swift.

Members of the cabinet Cllr Phil Ireland and Cllr Stanley Lumley have also departed.

Cllr Chapman, who represented Harrogate Bilton Grange, was mayor of the Harrogate borough last year.

The Liberal Democrat was on the council since 2018.

Richard Cooper

Leader of the council since 2014, Conservative Cllr Cooper represented Harrogate central on the authority.

He announced in October 2021 that he would not seek election to North Yorkshire Council.

Ed Darling

Conservative Cllr Darling was chair of the licensing committee on Harrogate Borough Council and represented Knaresborough Castle ward.

John Ennis

John Ennis, Conservative.

Cllr Ennis, a Conservative, represented the Harrogate Stray ward on the authority.

Sam Green

Sam Green, who was the youngest councillor on Harrogate Borough Council.

Cllr Green, who was only elected in May last year, was the youngest borough councillor at 26-years-old.

He was elected to the Wathvale ward on the council.

Sid Hawke

Cllr Hawke was one of two Ripon Independent councillors on the borough council.

Phil Ireland

Conservative Cllr Ireland was one the authority’s cabinet. He held the carbon reduction and sustainability portfolio.

He also represented Knaresborough Aspin and Calcutt ward.

Steven Jackson

Cllr Jackson was a Conservative councillor who represented the Harrogate Saltergate ward on the council.

Sue Lumby

Cllr Lumby was the Conservative councillor for Harrogate Coppice Valley. She also chaired the council’s human resource committee.

Stanley Lumley

Conservative Cllr Lumley was the authority’s cabinet member for culture, tourism and sport and oversaw the creation of Brimhams Active, which now runs council leisure centres.

He unsuccessfully stood for election to the new North Yorkshire Council. He also represented Pateley Bridge and Nidderdale on the borough council.

Stuart Martin

Conservative Cllr Martin was mayor of Harrogate borough in 2020.

He represented Ripon Moorside on the authority.

Pauline McHardy

Cllr McHardy, who represented Ripon Minster, was a Ripon Independent on the borough council.

Nigel Middlemass

Cllr Middlemass was a Conservative councillor who represented Harrogate Kingsley ward.

Ann Myatt

Conservative Cllr Myatt represented Ouseburn ward on the borough council.

Tim Myatt

Cllr Myatt was part of the council’s cabinet and held the portfolio for planning.

He also represented Harrogate High ward.

Victoria Oldham

Conservative Cllr Oldham is the current mayor of the Harrogate borough. She chaired full council meetings this year.

Liberal Democrat Cllr Tom Watson represented Nidd Valley on the borough council.

Matthew Webber

Cllr Webber, who was a Liberal Democrat, represented New Park on the authority.

Christine Willoughby

Liberal Democrat Cllr Willoughby sat on the council for Knaresborough Eastfield.

Pressure is mounting for action to be taken to improve road safety around schools in Harrogate.

Harrogate and Knaresborough MP Andrew Jones has added his voice to calls for reduced speed limits and other measures.

It follows a collision on Thursday, February 2 outside Ashville College which saw two 15-year-old boys from Rossett School left with serious injuries.

Writing on his website, Community News, Mr Jones said he had written to the chief constable of North Yorkshire Police, Lisa Winward, to request immediate action.

He said he had called for mobile speed cameras to be deployed on Yew Tree Lane and Green Lane “as precautionary measures while the police investigate the cause of the accident”.

He has also asked Ms Winward to support traffic-calming measures around the area, including the introduction of 20mph zones outside the entrances to Rossett School and Ashville College.

He added:

“I have been supporting residents in the area for some time in their requests for the county council to work with the police to reduce speeds.

“While we do not yet know if speed was the cause of this incident, we do know that it is a real problem on the long straight roads near Rosset School (sic) and Ashville College.

“There is already a 20mph limit outside the Pannal Ash Road entrance to Rosset School (sic) but no obvious speed signage on Green Lane nor outside the entrance to Ashville on Yew Tree Lane. This seems odd and is something I would like the county council – who are the highways authority – to look at immediately.

“As a precaution too I have asked if police speed checks can be increased in the area while we await the outcome of the investigation. As soon as the investigation is completed any lessons must be identified and actions taken. Road safety around schools, all schools, is a priority.”

Meanwhile, a meeting last week saw 10 headteachers express their concerns to representatives of North Yorkshire County Council and North Yorkshire Fire and Rescue Service.

The meeting was chaired by Red Kite Learning Trust CEO Richard Sheriff and attended by the heads of Harrogate Grammar, Rossett, Rossett Acre, Ashville, Western, St Aidan’s, St John Fisher, Oatlands Infant and Oatlands Junior schools.

NYCC’s corporate director of business and environmental services, Karl Battersby, and highways area manager Melissa Burnham were also taken on a walking tour of the Oatlands area to see the problems and solutions proposed by local campaigners.

They also offered to do the same on Harlow Hill, and said they would report back with some proposals before Easter.

Dr Jenny Marks, who has spearheaded the campaign for changes for more than two years, told the Stray Ferret:

“It was very powerful that all the headteachers were there, and our councillors.

“The council representatives told us it was a difficult town to get changes in, but they definitely want to work with us on it.”

Councillors around the area have also been supporting the campaign, with two present at Wednesday’s meeting to back the schools’ concerns.

Cllr Mike Schofield, the Liberal Democrat representative for the Harlow and St George’s division of North Yorkshire County Council, said he has been backing the parents’ plans since the day he was elected.

He told the Stray Ferret:

“The tragic events of last week surely go to highlight the issues with the amount of traffic on our roads that are in very close proximity to four schools, one nursery and nursing homes. I know one of the two young men who were involved and get daily updates on their progress, which unfortunately could well be long and slow.

“If we really wish to promote active travel we need to ensure safer roads, safer crossings and safer footpaths. Council need to listen to local residents and have more meaningful and in-depth consultations and use local businesses when it comes to drawing up plans as they have greater knowledge and understanding of local issues.”

In the Oatlands area, parents have also been looking at measures including park-and-stride schemes using local car parks.

Parent Hazel Peacock, whose children attend Oatlands Infant and Junior schools, said they had had support from Cllr John Mann, the Conservative representative of the Oatlands division, who also attended the meeting.

Both he and Cllr Pat Marsh, the Lib Dem for Stray, Woodlands and Hookstone, had used some of their locality budgets to support the planned improvements.

Ms Peacock said she was hopeful NYCC would carry out improvements the footpath between Hookstone Road and Fulwith Mill Lane, to make it more usable even during winter months.
